Introduction to the Terms of Use

Our online store welcomes you and informs you that below you will find the terms and conditions governing your use of this store and all legal consequences arising from your use of the store’s services through the internet and this electronic platform.

The use of the store by any person, whether as a consumer of a service or product offered by the store or otherwise, constitutes their approval and acceptance, while having full legal capacity under Sharia, applicable regulations, and law, of all provisions and terms of this Agreement. It also confirms their commitment to comply with its rules and everything stated herein.

This Agreement applies to all forms of transactions between the Consumer and the Store. This Agreement shall become valid and effective upon your acceptance of it and commencement of registration with the Store, pursuant to Article 10 of the Saudi Electronic Transactions Law.

Article One – Introduction and Definitions

The above introduction forms an integral part of this Agreement. The following terms and definitions explain the principal expressions used in this Agreement:

Store: This definition includes all forms of the Store on the internet, whether an electronic application, a website, or a physical commercial establishment.
Consumer: A person who engages in e-commerce for the purpose of obtaining products or services provided by the Store through its electronic platform.
Agreement: This term refers to the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement.

Article Two – Legal Capacity of the Consumer

The Consumer acknowledges that they have the legal capacity required under Sharia and applicable regulations to deal with the Store, or that they are at least eighteen (18) years of age.
The Consumer agrees that, in the event of violating this Article, they shall bear the consequences of such violation toward third parties.

Article Three – Nature of the Store’s Obligation

The Store’s obligation toward Consumers is to provide the relevant service or product.
The Store may provide additional services, such as after-sales services or other related services, depending on the nature and type of the service or product requested by the Consumer.

Article Four – Rules of Use

The Consumer shall use the Store’s electronic platform in a manner consistent with public morals and the laws and regulations applicable in the Kingdom of Saudi Arabia.
When purchasing a service or product from the Store, the Consumer shall not use such service or product in any manner that violates public morals or the laws and regulations applicable in the Kingdom of Saudi Arabia.

Article Five – Accounts and Registration Obligations

Upon applying to become a registered user or member of the Store, you are required to disclose certain information and choose a username and confidential password for use when accessing the Store’s services. By doing so, you agree to the following:

You are responsible for maintaining the confidentiality of your account information and password. You agree to notify the Store immediately of any unauthorized use of your account information or any other breach of your confidential information.
Under no circumstances shall the Store be liable for any direct or indirect, material or non-material loss suffered by you as a result of the disclosure of your username or password information.
You shall personally use your account or membership with the Store and shall be fully responsible for it. If another person uses your account, this shall be deemed evidence that you have authorized that person to use the Store in your name and on your behalf.
You agree to use the Store with seriousness, honesty, and good faith.
You agree to provide true, correct, current, complete, and lawful information about yourself as required during registration with the Store, and to update such information whenever it changes or whenever an update is required.
The Store undertakes to treat your personal information and contact details with complete confidentiality.
If the Store determines that you have provided information that is false, inaccurate, outdated, incomplete, unlawful, or contrary to this Terms of Use Agreement, the Store shall have the right to suspend, freeze, or cancel your membership or account on the platform, without prejudice to any other rights of the Store or lawful means available to recover its rights and protect other Consumers.
If you fail to comply with any of the above provisions, the Store’s management shall have the right to suspend or cancel your account or membership, or prevent you from accessing the Store’s services again.

Article Six – Electronic Communications and Official Means of Communication

The parties to this Agreement agree that communications shall take place through the email address registered on the platform.
The Consumer agrees that all agreements, notices, statements, and other communications provided electronically shall have the same effect as their written equivalents and shall constitute independent evidence sufficient to satisfy applicable legal and regulatory requirements.
The Consumer agrees that the Store may communicate with them and notify them of any provisions relating to this Agreement or their dealings with the Store through general messages sent to all Consumers or messages directed to specific users of the Store.

Article Seven – Amendments to the Terms of Use and Fees

If any Article or provision of this Agreement is cancelled, invalidated, or ceases to be enforceable, this shall not affect the validity of the remaining Articles, provisions, rules, and terms of this Agreement, which shall remain in force until further notice from the Store’s management.
This Agreement, as amended from time to time when necessary, constitutes the framework of operation, understanding, and agreement between the Consumer and the Store.
The Store may impose fees on certain Consumers depending on the offers, products, or services requested, or any fees or taxes imposed by the government according to the nature of the product or service.
The Store reserves the right to add, increase, reduce, deduct, or otherwise amend any fees or expenses pursuant to the provisions and terms of this Terms of Use Agreement, with respect to any Consumer regardless of the reason for their registration.

Article Eight – Payment and Settlement Services

The Store, through its partners, provides payment and settlement services. Payment may be made entirely online through the payment options available on the Store or through any other payment method that the Store may provide from time to time.
The Store shall determine the price of any service or product offered through the Store in accordance with generally recognized market value.
The Store shall provide invoices, receipts, and payment acknowledgements for amounts arising from transactions conducted through the Store, and shall provide the Consumer with an invoice for the purchase of a service or product.
The Store shall apply generally accepted accounting practices to its electronic store in accordance with the provisions of this Agreement and in furtherance of the relevant legal, economic, commercial, and regulatory interests.

Article Nine – Intellectual Property

The intellectual property rights relating to the Store are fully owned by the Store, whether such rights existed before the establishment of this electronic platform or arose after its establishment.
The Consumer shall respect the Store’s intellectual property rights, including the Store’s name, words, trademarks, logos, symbols, and other materials relating to or displayed by the Store. All such rights associated with the Store are fully protected intellectual property rights belonging to the Store.

Article Ten – Store Liability

The Store shall conduct its commercial activities through this electronic platform lawfully and in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia and the provisions of this Agreement.
The Store shall not be responsible for claims arising from errors or negligence, whether direct, indirect, incidental, caused by the Consumer, or caused by a third party such as shipping companies.
The Store, its employees, owners, and representatives shall ensure that the product or service is lawful, legitimate, and permitted under the laws and regulations of the Kingdom of Saudi Arabia and is used for lawful purposes.

Article Eleven – Restriction of Access or Membership

The Store may suspend or cancel the Consumer’s membership or restrict the Consumer’s access to the platform’s services at any time, without prior notice and for any reason.

Article Twelve – Governing Law and Applicable Regulations

This Terms of Use Agreement is governed by and interpreted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia and is fully subject to the regulations applied by the competent authorities in the Kingdom of Saudi Arabia.

Article Thirteen – General Provisions

If any Article or provision of this Terms of Use Agreement is cancelled, invalidated, or ceases to be enforceable, this shall not affect the validity of the remaining Articles, provisions, and terms of this Agreement, which shall remain in force until further notice from the Store’s management.

This Terms of Use Agreement, which may be amended from time to time as necessary, constitutes the terms of use, operating framework, understanding, agreement, and contractual relationship between the Store and the Consumer.

The parties also agree that the following shall be taken into consideration:

Arabic shall be the governing language for the interpretation of the provisions of this Agreement or in the event that the Agreement is translated into another language.
All prices displayed for the Store’s services or products may be amended from time to time.
Promotional or marketing offers provided by the Store are temporary. The Store has the right to amend or discontinue such promotional or marketing offers at any time.
The parties to this Agreement shall deal with each other in a manner that does not violate Sharia principles or the applicable laws and regulations relevant to the nature of the relationship between the Store and the Consumer.
This Terms of Use Agreement may only be terminated pursuant to a decision issued by the Store’s management.
